The Dhaka Metropolitan Sessions Judge Court has rejected BNP Secretary General Mirza Fakhrul Islam Alamgir's bail plea in the case of vandalism at the residence of the Chief Justice in Kakrail of the capital.
Fakhrul's bail hearing began at 2:40 pm on Wednesday (November 22) at the Dhaka Metropolitan Sessions Judge's Court. The hearing ended at 3:13 p.m.
Mirza Fakhrul Islam Alamgir’s bail hearing were plead by senior lawyer Advocate Masud Ahmed Talukder, Md. Asaduzzaman, Md. Mohsin Mia, Gholam Mostafa Khan, Mosleh Uddin Jasim, Khorshed Mia Alam, Omar Farooq Farooqui, Iqbal Hussain, Hazrat Ali and Zainul Abedin Mejbah.
While Advocate Abdullah Abu, Sheikh Hemayet Uddin, Dhaka Bar President Mizanur Rahman Mamun, General Secretary Khandkar Golam Kibraya Zobair and other lawyers were on the state side.
Fakhrul's lawyer Masud Ahmed said in the hearing that there is no specific complaint against Mirza Fakhrul Islam Alamgir. None of the victims of the alleged incident have been made witnesses in this case, those who have been made witnesses have no address in Dhaka. Mirza Fakhrul is sick, 81 years old, has 4 blocks. He wants Fakhrul's bail.
Advocate Asaduzzaman and Advocate Badruddoza Badal also conducted the hearing. They said that the accused in the case of attack on the Chief Justice's residence was made so that he would not gain sympathy from the judiciary.
Fakhrul's bail was opposed by Metropolitan PP Advocate Abdullah Abu. He said, to be accused, it is not necessary to be present at the place of occurrence, even if he instructs or induces to do that act, he will be accused in the case.
After the hearing, the Acting Judge of the Metropolitan Sessions Judge's Court, Faisal Atiq Bin Quader, did not grant the bail prayer.
On October 29, around 9:30 am, Mirza Fakhrul was arrested by the Detective Branch (DB) of Dhaka Metropolitan Police (DMP) from his home in Gulshan. When he was produced in court on October 29, the Metropolitan Magistrate Court of Dhaka rejected his bail and ordered him to be sent to jail.
It was alleged that, during the pre-announced general meeting of the Bangladesh Nationalist Party BNP on October 28, the top leaders of BNP and its affiliated organizations from different parts of Bangladesh armed with various deadly weapons including sticks, iron rods, bricks and cocktails vandalized the residence of the Chief Justice. An illegal assembly was held in front of the building, shouting anti-state slogans and marching. At that time, they vandalized several buses, pickups, including buses of Boishakhi transport and caused damage of Taka 20 (twenty) lakh.
